POLICY OF PRIVACY & DATA PROTECTION

DMS, as the operator of the Platform, respect the privacy of individuals with regards to Personal Data. This Privacy Policy is prepared and formulated in accordance with the Malaysian Personal Data Protection Act 2010 (“the Act”). For the purpose of this Privacy Policy, “Personal Data” shall have the meaning as ascribed to in the Act. DMS is committed to processing your Personal Data within the ambit of the Act.

Scope of the Act

The Act primarily aims to regulate the collection, holding, processing and use of Personal Data in commercial transactions and to prevent malicious use of Personal Data.

What Personal Data Do We Collect?

DMS will collect certain Personal Data when you sign up an account for the Services with us and/or any additional information required from time to time in connection with the provision of Services. In additional to the above, there are certain Personal Data collected when you ………………….

The Personal Data which DMS may collect are as follows:

  1. Personally identifiable information such as Name, Identity Card No./Passport No., Gender, Age
  2. Contact information such as Address, Telephone number, E-mail address
  3. Payment information such as credit/debit card/bank account information (name of cardholder, card no, bank account no., issuing bank, issuing country, expiry date, etc.)
  4. Technical Information such as Internet Protocol ("IP") address, browser type, browser version, the pages on the Platform visited, time and date of visit, duration spent and other statistics.
  5. Any other essential information that may be reasonably required to performance of the Services under these T&Cs.

DMS collects information that your browser sends whenever you visit our Platform ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyse these Log Data.

By using the Sites, User consents to DMS’s use of cookies to enable the efficient operation of the Platform, enhance the ease of use of the Platform, and/or to gather statistics on users’ visits. You may opt out of cookies by instructing your browser to refuse all cookies or to indicate when a cookie is being sent, but this will result in certain functionalities on the Platform being no longer useable to you.

What is the Purpose of Collecting User’s Personal Data?

DMS uses your Personal Data only for the provision of Services and improving the Platform. By using the Platform, you agree to the collection, retention and use of your Personal Data for the Purposes listed below in accordance with this Privacy Policy and the Act:

The Personal Data is collected and processed for purposes which may include the following (“Purposes”):

  • Administrative : To process your application for our Services and/or use of our Platform;
  • Communication : Sending notification in the provision of Services and/or other purposes in accordance with these T&Cs, responding to your enquiries or complaints;
  • Performance of Services : For carrying out our obligations and enforcing our rights these T&Cs;
  • Analysis : Marketing and statistical analysis
  • Marketing : Sending any newsletters or promotional materials on our Services; and
  • Prevention & Compliance : To comply with any applicable laws, legal or regulatory requirements and/or to make any disclosure under any applicable law, regulations, court orders or guidelines.
Do We Share and Disclose User’s Personal Data?

DMS does not sell, rent, lease or otherwise disclose your Personal Data to third parties unless otherwise stated when processing the Personal Data collected and/or as requested by any authorised regulatory/governmental bodies/agencies whenever required by law, where DMS consider that such use or disclosure in necessary to respond to any claims or legal process, or where DMS suspects any form of fraud or unlawful activity.

What Happens If User Decides Not To Provide Personal Data?

Certain Personal Data are compulsorily required by DMS for the provision of Services that you had requested for and other stated purposes above. Should you decide not to provide the compulsory Personal Data required, DMS is unable to proceed with the provision of Services satisfactorily and efficiently.

On the other hand, Personal Data which are not marked with asterisk are not compulsorily requires and as such, provision of such Personal Data is entirely at your discretion. DMS provides Users with an avenue to opt-out or unsubscribe from receiving marketing, communications, promotional offers, newsletters or any other non-essential notification from DMS.

What Are The Steps Taken to Safeguard User’s Personal Data?

DMS is required under the Act to protect and safeguard your Personal Data by taking practical steps to implement security measures thereto, i.e. to protect your Personal Data from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction.

We have assigned specific responsibilities to address privacy and security related manners and do enforce our internal policies and guidelines through an appropriate selection of activities. Further, we also take steps to limit access to our databases containing Personal Data to authorized persons having the justified need to access such information.

The safety and security of your Personal Data is of utmost importance to us. While we strive to use commercially acceptable means to protect our Users’ Personal Data, it is important to note that no method of transmission over the internet or method of electronic storage is 100% secure. As such, DMS cannot guarantee its absolute security.

Users are encouraged to take steps to protect their own Personal Data, such as using strong and unique passwords, keeping their account credentials secure, and being cautious about sharing your Personal Data online. Users should also be mindful of the risks associated with transmitting information over the internet and understand that no online platform can be completely immune to security breaches.

By using our Services, Users acknowledge and accept the inherent risks associated with online data transmission and agree that DMS cannot be held liable for any unauthorized access or disclosure of Personal Data that is beyond DMS’s reasonable control.

How Long Do We Retain User’s Personal Data?

The Personal Data shall not be kept for longer than is necessary for the performance of our obligations under these T&Cs and to fulfill any legal/financial requirements. Whilst the Act does not stipulate the time frame allowed for storage of your Personal Data, DMS shall destroy and/or permanently delete your Personal Data once it is no longer required for the purpose for which it was processed.

Your Rights

The Act accords five (5) rights to individuals to safeguard their Personal Data as listed below:

  1. The Right of Access Personal Data
    Subject to the provisions of the Act, you have the right to access your Personal Data and/or to correct your Personal Data with DMS should you believe that the Personal Data provided is incorrect, outdated, inaccurate or incomplete.
  2. The Right to Delete/Correct Personal Data
    You may request for the Personal Data provided to be deleted and/or corrected if your Personal Data is inaccurate, incomplete, misleading or not up-to-date.
  3. The Right to Withdraw Consent
    The consent which you have granted in respect of the processing of your Personal Data will not endure forever. You may by notice in writing withdraw the consent granted at any time. DMS shall cease processing of your Personal Data upon receipt of your notice.
  4. The Right to Prevent Processing for the Purposes of Direct Marketing
    DMS shall process your Personal Data in strict adherence to the consent which you have granted in respect of the processing of your Personal Data.
    Should you receive marketing materials from DMS and you wish to discontinue such receipt of marketing information, you may provide DMS with a “opt out” notice to remove/delete your Personal Data from DMS’s database. Once an “opt out” notice has been received from you, DMS shall within a reasonable time remove/delete your Personal Data from our database.
  5. The Right to Prevent Processing which is likely to cause Damage or Distress
    You have the absolute right to prevent the processing of your Personal Data where your consent has not been obtained for such specific purposes and where such processing of your Personal Data will cause or is likely to cause substantial unwarranted damage or distress to you or another person.
Change/Amendments to this Privacy Policy

DMS may, from time-to-time, update or change the contents of this Privacy Policy. However, if the changes made are material, DMS will post a prominent notice advising of such change at the beginning of on our Platform and use reasonable means to communicate to you such change within twenty-one (21) days from such change. We encourage you to check this Privacy Policy periodically.
